Consegne Italia: se il corriere  non dovesse trovare nessuno al momento della prima consegna, provvederà ad effettuare una seconda consegna gratuita il giorno seguente, se anche questa dovesse risultare inefficace, il corriere lascerà un avviso di mancata consegna ed il pacco rimarrà in giacenza gratuita a disposizione per il ritiro per 7 giorni presso l’ufficio postale più vicino. Allo scadere dei 7 giorni, il pacco ritornerà al mittente e non sarà effettuato nessun rimborso all’acquirente.

  1. I Termini e Condizioni che seguono si applicano a tutti i rapporti commerciali Envidiame ed il cliente che si sono instaurati attraverso la Vetrina virtuale. È da ritenersi valida la versione in vigore al momento della conclusione del contratto.
  • 2 Offerta, accettazione, conclusione del contratto
  1. Le nostre offerte sono soggette a cambiamento senza preavviso e non sono vincolanti.
  1. Quando il cliente ordina i prodotti desiderati, fa una dichiarazione vincolante della sua offerta contrattuale. Noi confermeremo la ricezione dell’ordine senza indugi. La conferma di ricezione non rappresenta un’accettazione vincolante dell’ordine.
  1. Nel caso in cui l’esecuzione delle transazioni legali, delle consegne o dei servizi offerti richieda il soddisfacimento della legge tedesca o europea per il commercio estero o dei regolamenti statunitensi per il controllo delle esportazioni, l’adempimento del contratto sarà soggetto alla condizione sospensiva. Se tale soddisfacimento non viene accordato o non è osservato, o se non vengono adempiute le clausole collaterali relative al contenuto, il contratto non entrerà in vigore.
  1. Nel caso in cui i prodotti non siano disponibili o lo siano solo in parte, ci riserviamo il diritto di non fornirli, di fornirli solo in parte o di fornirli in data successiva. Il cliente ne verrà informato senza indugio.
  • 3 Spedizione / tempi di consegna / condizione riguardante la consegna
    1. Inizieremo immediatamente la procedura d’ordine ed effettueremo la spedizione entro 1 – 3 giorni in Italia e 3 -5 giorni in altri paesi. In casi eccezionali i tempi di consegna potranno essere più lunghi. Nessun prodotto verrà spedito il sabato e la domenica. Per la spedizione dei nostri prodotti ci affidiamo, tra gli altri, all’assistenza di Export Box di Poste Italiane.
  • 4 Conservazione del titolo
  1. Ci riserviamo la proprietà dei beni fino al pagamento completo del prezzo di acquisto.

Il cliente è obbligato a conservare i prodotti con cura fintanto che dura la riserva della proprietà.

  • 5 Diritto di recesso da parte del cliente

Diritto di recesso

  1. Il cliente può revocare il proprio ordine per iscritto e restituendo l’articolo entro un periodo di due settimane senza fornirne le ragioni. Tale periodo inizierà non prima di ricevere questa informazione. Per rispettare questo periodo di recesso è sufficiente spedire la revoca o restituire l’articolo nei tempi indicati. Conseguenze del recesso

  1. Se si effettua un recesso i servizi ricevuti da entrambe le parti devono essere restituiti. Se i prodotti ricevuti non possono essere restituiti totalmente o in parte o possono essere restituiti solo danneggiati, il cliente paga il risarcimento per il valore perduto.
  2. Quando il consumatore restituisce prodotti spediti, dovrà coprire le spese di spedizione se i beni consegnati corrispondevano all’ordine ed il prezzo di acquisto non è stato ancora pagato. 
  • 6 Prezzi e pagamento
  1. Tutti i prezzi della nostra Vetrina virtuale sono indicati in Euro ed includono l’imponibile IVA.
  1. Le offerte speciali che offriamo per un certo periodo di tempo sono segnalate nella descrizione individuale dei prodotti sul nostro sito internet.
  1. Si può effettuare il pagamento del prezzo di acquisto tramite bancomat o carta di credito (Visa o MasterCard).
  • 7 Garanzia di 2 anni di qualità perfetta / garanzia
  1. I prodotti di Envidiame sono di alta qualità. Se, a dispetto di un trattamento adeguato, si verificasse un difetto di processo o di materiale entro due anni dalla data della ricevuta, ce ne assumeremo la responsabilità e sostituiremo o ripareremo il prodotto.
  2. In caso di reclamo di garanzia, il cliente potrà semplicemente spedirci il prodotto, allegando la fattura originale.
  • 8 Limitazioni di responsabilità
  1. Nel caso di una semplice violazione per negligenza di obblighi contrattualmente non essenziali e quando tale violazione non metta a repentaglio l’esecuzione del contratto, non saremo responsabili. Le limitazioni di responsabilità sopraindicate non avranno alcun effetto su eventuali reclami del cliente derivanti da responsabilità o garanzie del prodotto. Inoltre, le limitazioni di responsabilità non si applicheranno in caso di danni fisici, deterioramento della salute o morte attribuibili a noi.
  1. Siamo responsabili solamente del contenuto del nostro sito internet. Quando forniamo collegamenti per accedere ad altri siti non siamo responsabili del contenuto di tali siti. Non ci assumiamo nessuna responsabilità per i contenuti esterni. Se riceveremo informazioni su contenuti illegali di siti internet esterni, bloccheremo il collegamento a tali pagine senza indugio.
  • 9 Normative finali

  1. Il luogo esclusivo di giurisdizione per tutte le dispute che sorgono da questo contratto sarà costituito dalla nostra sede centrale a Fano.

Se una qualsiasi delle norme di questo contratto con il cliente, inclusi questi Termini e Condizioni, dovesse essere o diventare inefficace interamente o in parte, ciò non compremetterà la necessità di osservare le altre norme. La norma inefficace interamente o in parte sarà sostituita da una norma che corrisponda al fine commerciale della norma inefficace.

Orders are dispatched by ENVIDIAME from Monday to Friday from 9.00 am to 1.00 pm.   Orders received on Saturdays – Sundays and public holidays will be dispatched on Monday or at the following business day.

ENVIDIAME dispatches to all around the world using EXPORT BOX by Poste Italiane.

While placing the order, it’s important you provide the correct email adress and phone number.

Delivery to Italia: If the courier delivers your parcel when you’re not in, he will try to deliver it another time at no additional charge. If this second attempt fails, the courier will leave a note of failed delivery and the parcel will be stocked at the nearest post office for 7 days. After 7 days, the parcel will be sent back to the sender and no reimbursement will be granted to the buyer.

Delivery to the rest of the world: If the courier delivers your parcel when you’re not in, they will try to deliver it another time at no additional charge. If this second attempt fails, the courier will leave a card to advise this to you and the parcel will be stocked at the local depot for 7 days. After 7 days, the parcel will be sent back to the sender and no reimbursement will be granted to the buyer.

If you have already placed your order, we will not be able to change the delivery address. Orders are delivered from Monday to Friday from 9.00 am to 6.00 pm.

ENVIDIAME does not accept any responsibility for delays of its service caused as a result of circumstances beyond our control,  for international shipping delays, such as customs delays and is not responsible for any customs duties or taxes.

ENVIDIAME reserves the right to postpone the deliver in case of events caused by force majeure.

    • 1 General – Scope of Application
    1. The Terms & Conditions below shall apply to all business relationships between Envidiame and the customer formed through the Online Shop. The version in force at the time the contract is concluded shall be the relevant version.

     

    • 2 Offer, acceptance, conclusion of contract
    1. Our offers are subject to change without notice and are not binding.

     

    1. By ordering the desired goods, the customer makes a binding declaration of their contractual offer. The receipt of the order shall be confirmed by us without delay. The confirmation of receipt does not represent a binding acceptance of the order.

     

    1. Insofar as the fulfillment of the legal transactions, deliveries or services offered requires any approval under German or European foreign trade law or the U.S. Export Control Regulations, the fulfillment of the contract shall be subject to the condition precedent. If such approval is not granted or not complied with, or if subject-matter-related collateral clauses are not fulfilled, the contract shall be ineffective.

     

    1. In case the goods are not or are only partially available, we reserve the right not to supply, to supply only part of the goods or to supply later. The customer will be informed of this without delay.

     

    • 3 Dispatch/delivery period/proviso regarding delivery
      1. We will process your order promptly and effect shipment within 1 -3 days in Italy and 3 -5 days in other countries. In exceptional cases, the delivery period may be longer. No goods will be dispatched on Saturdays and Sundays. For the shipment of our goods we rely on the services of Export Box of Poste Italiane.

     

    • 4 Retention of title
    1. We shall reserve the ownership of the goods until full payment of the purchase price.

     

    1. The customer shall be obliged to handle the goods with care for as long as the reservation of ownerships lasts.

     

    • 5 Right of revocation for the consumer – Right of withdraval
    1. Consumers may revoke their order in writing and by returning the item within a period of two weeks without providing reasons. This period shall begin at the earliest when this information is received. To comply with the revocation period it is sufficient to dispatch the revocation or return the item in good time.

    Consequences of withdraval

    1. If an effective withdraval has been made, the services received by both parties shall be returned. If the goods received cannot be returned in whole or in part or can only be returned in damaged condition, the consumer has to provide compensation for lost value.
    2. When returning goods from a shipment, the consumer shall bear the cost of the return shipment if the delivered goods were in accordance with the order and the purchase price was not yet paid. Otherwise the return shipment shall be free of cost.

     

    • 6 Prices and payment
    1. All prices in our Online Shop are indicated in Euro including statutory VAT.

     

    1. Limited special offers are identified as such in the description of the individual items on our website.

     

    1. The payment of the purchase price can be effected by direct debit or by credit card payment (Visa or MasterCard).

     

    • 7 2-year-warranty for perfect quality / guarantee
    1. Envidiame products are high-quality products. If, despite proper treatment, a processing or material defect should nonetheless occur within two years of the invoice date, we will assume responsibility and replace or repair the product
    2. In case of a warranty claim, the customer can simply return the product to us, enclosing the original invoice.

     

    • 8 Restrictions of liability
    1. In case of a slightly negligent breach of non-essential contractual obligations and where such breach does not place at risk the fulfillment of the contract, neither we nor our vicarious agents shall be liable. The above limitations of liability shall not affect any claims of the customer arising from product liability or warranties. Further, the liability limitations shall not apply to physical injuries, health impairment or deaths attributable to us.

     

    1. We are liable only for our own contents on our web site. Where we provide links enabling access to other web sites, we shall not be responsible for the contents of such sites. We do not assume any responsibility for external contents. If we receive any information about illegal contents on external websites, we will block the link to such pages without delay.

     

    • 9 Final provisions
    1. D. Lgs. 206/05 ed il D. Lgs. 70/03 are the applicable laws. The provisions of the UN purchase law shall not apply.

     

    1. The exclusive place of jurisdiction for all disputes arising from this contract shall be our headquarters in Fano.

     

    1. Should any provisions of this contract with the customer, including the present Terms and Conditions, be or become ineffective in whole or in part, this shall not affect the enforceability of the other provisions. The provision that is ineffective in whole or in part shall be replaced by a provision that corresponds to the commercial purpose of the ineffective provision.
